PART A — END USER LICENSE AGREEMENT (EXTENSION)

||||||

||||||
|
|
||||||
|
1. DEFINITIONS
|
||||||
|
|
||||||
|
"Extension" means the "ench - sftp" Visual Studio Code / Cursor extension
|
||||||
|
(package name ench-sftp, publisher ench), including its compiled artifacts,
|
||||||
|
configuration, and documentation, as distributed by Licensor through the
|
||||||
|
Visual Studio Marketplace, Open VSX, or other channels authorized by Licensor.
|
||||||
|
|
||||||
|
"Licensor" means ENACHE MARIO-ANDREI PERSOANA FIZICA AUTORIZATA, registered
|
||||||
|
at B-dul Bucurestii Noi nr. 136, sector 1, Bucuresti, Romania, Trade Register
|
||||||
|
no. F2026012267008, tax identification code 54189465, operating under the
|
||||||
|
brand "ench." at www.ench.ro.
|
||||||
|
|
||||||
|
"ench Services" means SFTP servers operated by Licensor or expressly authorized
|
||||||
|
by Licensor for use with the Extension. Connection targets are restricted to
|
||||||
|
hosts published by Licensor (including via the dynamic allowlist at
|
||||||
|
cdn.ench.ro) and may change without notice.
|
||||||
|
|
||||||
|
"You" means any individual or legal entity that installs, accesses, or uses
|
||||||
|
the Extension.
|
||||||
|
|
||||||
|
|
||||||
|
2. GRANT OF LICENSE
|
||||||
|
|
||||||
|
Subject to Your compliance with this Part A, Licensor grants You a limited,
|
||||||
|
personal, non-exclusive, non-transferable, revocable license to install and use
|
||||||
|
the Extension solely to access ench Services for managing game-server files
|
||||||
|
associated with Your ench account.
|
||||||
|
|
||||||
|
No other rights are granted. All rights not expressly granted are reserved.
|
||||||
|
|
||||||
|
|
||||||
|
3. RESTRICTIONS
|
||||||
|
|
||||||
|
You may NOT, without prior written permission from Licensor:
|
||||||
|
|
||||||
|
(a) use the Extension to connect to SFTP servers that are not ench Services,
|
||||||
|
including third-party, self-hosted, or competitor infrastructure;
|
||||||
|
|
||||||
|
(b) use the Extension as a general-purpose SFTP client or remote file manager
|
||||||
|
unrelated to ench Services;
|
||||||
|
|
||||||
|
(c) sublicense, sell, rent, lease, transfer, distribute, publish, or otherwise
|
||||||
|
make the Extension available to third parties;
|
||||||
|
|
||||||
|
(d) circumvent, disable, tamper with, or attempt to bypass the host allowlist,
|
||||||
|
access controls, or other technical restrictions in the Extension;
|
||||||
|
|
||||||
|
(e) reverse-engineer, decompile, disassemble, or create derivative works based
|
||||||
|
on the Extension for the purpose of building or supporting a competing
|
||||||
|
remote-file or SFTP product or service;
|
||||||
|
|
||||||
|
(f) remove, alter, or obscure any copyright, trademark, or other proprietary
|
||||||
|
notices in the Extension; or
|
||||||
|
|
||||||
|
(g) use any brand name, logo, or trademark of Licensor (including "ench." and
|
||||||
|
"ench.ro") without separate prior written authorization.
|
||||||
|
|
||||||
|
|
||||||
|
4. ALLOWLIST AND TECHNICAL CONTROLS
|
||||||
|
|
||||||
|
You acknowledge that the Extension restricts connection targets to ench Services
|
||||||
|
through a host allowlist maintained by Licensor. Licensor may modify, expand,
|
||||||
|
or revoke allowed hosts at any time. Failure to load or satisfy the allowlist
|
||||||
|
does not entitle You to connect to non-ench servers using the Extension.
|
||||||
|
|
||||||
|
|
||||||
|
5. TERMINATION
|
||||||
|
|
||||||
|
This license is effective until terminated. It terminates automatically,
|
||||||
|
without notice, if You breach any term of this Part A. Upon termination You
|
||||||
|
must uninstall the Extension and cease all use. Sections 6, 7, and 8 survive
|
||||||
|
termination.
|
||||||
|
|
||||||

|
6. DISCLAIMER OF WARRANTIES
|
||||||
|
|
||||||
|
THE EXTENSION IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
|
||||||
|
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS
|
||||||
|
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT
|
||||||
|
THE EXTENSION WILL MEET YOUR REQUIREMENTS OR THAT OPERATION WILL BE
|
||||||
|
UNINTERRUPTED OR ERROR-FREE.
|
||||||
|
|
||||||
|
|
||||||
|
7. LIMITATION OF LIABILITY
|
||||||
|
|
||||||
|
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR
|
||||||
|
BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL
|
||||||
|
DAMAGES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL) ARISING OUT
|
||||||
|
OF OR IN CONNECTION WITH THE EXTENSION OR THIS LICENSE, EVEN IF ADVISED OF
|
||||||
|
THE POSSIBILITY OF SUCH DAMAGES.
|
||||||

|
8. GOVERNING LAW AND JURISDICTION
|
||||||
|
|
||||||
|
This Part A shall be governed by and construed in accordance with the laws of
|
||||||
|
Romania, including Legea nr. 8/1996 privind dreptul de autor si drepturile
|
||||||
|
conexe and the Romanian Civil Code (Legea nr. 287/2009). Any dispute arising
|
||||||
|
out of or in connection with this Part A shall be subject to the exclusive
|
||||||
|
jurisdiction of the competent courts of Bucharest, Romania.
|
||||||

PART B — SOURCE CODE LICENSE (REPOSITORY)
|
||||||
|

|
|
||||||
|
1. DEFINITIONS
|
||||||

|
||||||
|
"Software" means the source code, compiled artifacts, design assets,
|
||||||
|
configuration files, and accompanying documentation for the ench-sftp VS Code
|
||||||
|
extension contained in this repository, in whole or in part.
|
||||||
|
|
||||||
|
"Licensor" has the meaning given in Part A.
|
||||||
|
|
||||||
|
"Authorized Personnel" means individuals who have been granted explicit written
|
||||||
|
access to this repository by Licensor. Access is personal, non-transferable,
|
||||||
|
and remains valid only for as long as it has not been revoked by Licensor.
|
||||||
|
|
||||||
|
"You" means any individual or legal entity accessing the Software in source
|
||||||
|
form.
|
||||||
|
|
||||||
|
|
||||||
|
2. GRANT OF RIGHTS
|
||||||
|
|
||||||
|
Subject to the terms of this Part B, Licensor grants Authorized Personnel a
|
||||||
|
limited, non-exclusive, non-transferable, revocable right to:
|
||||||
|
|
||||||
|
(a) access, read, and modify the Software solely within the scope of tasks
|
||||||
|
directly authorized by Licensor; and
|
||||||
|
|
||||||
|
(b) compile and run the Software locally for development and testing purposes
|
||||||
|
directly related to their work for Licensor.
|
||||||
|
|
||||||
|
All rights granted under this Section terminate automatically and without notice
|
||||||
|
upon revocation of repository access by Licensor. No rights of any kind are
|
||||||
|
granted to any person who is not Authorized Personnel.
|
||||||
|
|
||||||
|
|
||||||
|
3. RESTRICTIONS
|
||||||
|
|
||||||
|
You may NOT, without prior written permission from the Licensor:
|
||||||
|
|
||||||
|
(a) copy, reproduce, distribute, publish, or transmit the Software or any
|
||||||
|
portion of it in any medium or form, except as expressly permitted for
|
||||||
|
Authorized Personnel under Section 2;
|
||||||
|
|
||||||
|
(b) sublicense, sell, rent, lease, transfer, or otherwise make the Software
|
||||||
|
available to third parties;
|
||||||
|
|
||||||
|
(c) modify, adapt, translate, reverse-engineer, decompile, disassemble, or
|
||||||
|
create derivative works based on the Software, except as expressly permitted
|
||||||
|
for Authorized Personnel under Section 2(a);
|
||||||
|
|
||||||
|
(d) remove, alter, or obscure any copyright, trademark, or other proprietary
|
||||||
|
notices contained in the Software;
|
||||||
|
|
||||||
|
(e) use the Software, its design, structure, or logic as the basis for a
|
||||||
|
competing product or service; or
|
||||||
|
|
||||||
|
(f) use any brand name, logo, or trademark of Licensor (including "ench." and
|
||||||
|
"ench.ro") without separate prior written authorization.
|
||||||
|
|
||||||
|
|
||||||
|
4. INTELLECTUAL PROPERTY
|
||||||
|
|
||||||
|
The Software and all copies thereof are proprietary to Licensor and title
|
||||||
|
thereto remains with Licensor. All work product created by Authorized Personnel
|
||||||
|
in connection with their work for Licensor is considered work made for hire and,
|
||||||
|
to the extent it does not qualify as such under applicable law (including art.
|
||||||
|
44 din Legea nr. 8/1996 privind dreptul de autor si drepturile conexe), is
|
||||||
|
hereby irrevocably assigned in writing to Licensor. All rights in the Software
|
||||||
|
not specifically granted in this Part B are reserved to Licensor.
|
||||||
|
|
||||||
|
|
||||||
|
5. TERMINATION
|
||||||
|
|
||||||
|
This Part B is effective until terminated. It will terminate automatically
|
||||||
|
without notice if You fail to comply with any provision hereof, or upon
|
||||||
|
revocation of repository access by Licensor. Upon termination You must
|
||||||
|
immediately cease all use and destroy all copies of the Software in your
|
||||||
|
possession. Sections 4 and 6 through 8 of Part A (as applicable to the
|
||||||
|
Software) and Sections 4 and 6 of this Part B survive termination.

6. DISCLAIMER OF WARRANTIES
